Definitions

“Pollinate” or “EXLI” or “We” or “Us” refers to the Experiential Leadership Initiative, LLC (EXLI), the owner, creator and manager of the pollinate.life software and technology platform.

Users” or “You” of “Your” refers to you or any persons, including but not limited to, individuals, the company You represent, students and people enrolled in a Practice Program via the Platform or visitors to any pages part of the www.pollinate.life domain.

Program Provider” or “Content Provider” means any individual, organization or group of people using the Platform to engage and sell Services to Users in connection with a Practice Program.

Practice Program” or “Submitted Content” means Program Provider owned and/or controlled content including, but not limited to, training materials, videos, products, content, graphics, voice, and sound recordings, photos, documents, text, and other resources, for which Program Provider wishes to utilize the Pollinate.life Platform to promote, publish, and distribute content to Users.

Pollinate.life Platform” or “Platform” refers to EXLI’s proprietary software, web site and App development, publishing, and e-commerce tools, content and services which allows Program Providers to create, develop, enhance, market, publish, distribute, and sell Practice Programs to Users.

Content” or “Services” or “Products” refers to all software, technology, designs, materials, information, communications, text, graphics, links, electronic art, animations, illustrations, artwork, audio clips, video clips, photos, images, reviews, ideas, and other data or EXLI copyrightable materials or content, including the selection and arrangements thereof.

Privacy Policy

This Privacy Policy (“Privacy Policy”) explains how EXLI collects, uses and shares personally identifiable information of Users of the Platform and of Our Services.  Please note that the primary purpose of our Platform and the Services is to allow Users to enroll in and participate in Practice Programs.

When this Privacy Policy uses the generic term “information” it is intended to address the general use of information, and not your specific Platform Information or Practice Program Information. By using the Platform, Services, or Practice Programs You consent to the collection, use and disclosure of your personally identifiable Information and Practice Program Information, as applicable, in accordance with this Privacy Policy.

Information We Collect

You can generally visit the Site without revealing any personally identifiable information about yourself. We do not collect personal information from our Platform visitors without the Platform visitor providing us with this information as set forth in this Privacy Policy.

If you request to receive Product information, or request information about specific Services, or provide comments about Services, you will be asked to provide contact information so that we can complete your request. We use this Information to fulfill your request. We may also use this Information to send you additional information about our Services or Practice Programs on the Platform that you may be interested in.

Some of the Services require that you become a registered user and create a user account. This will require that you provide certain personally identifiable information, that may include (but not be limited to) your name, e-mail address, as well as mobile phone and physical address.

What We Do with Your Information

General Use

You allow us to use this personally identifiable Platform Information to:

  1. register you to use the Services, enroll in Practice Programs, and otherwise provide you with the Services

  2. verify your authority to enter the Platform and access the Practice Programs and Services

  3. notify you of updates

  4. improve the content and general administration of the Platform and the Services

  5. provide you with notices regarding the Services and other services that you have purchased or may wish to purchase in the future.

Use By Program Providers

You also consent to our providing this personally identifiable information to Program Providers as part of the Practice Program Information when you enroll in a Practice Program. Program Providers will use this Information to provide the Practice Program to you. Program Providers may have other users for Practice Program Information. It is your responsibility when you enroll in a Practice Program to confirm what uses the Program Provider will make of your personally identifiable Practice Program Information. EXLI does not control these uses by Program Providers.

Program Providers may collect non-personally identifiable Information in connection with your participation in Practice Programs. This Practice Program Information may include, but not be limited to, your interaction with the Program Provider and other Users, comments you leave on Practice Program forums, answers or essays you submit to satisfy Practice Program requirements, and so forth. As noted above, it is your responsibility to review the Program Provider’s policy in connection with all Practice Program Information and decide whether or not you want to provide such Practice Program Information.

You may access the Program Provider Terms at www.pollinate.life/programproviderterms. They outline the terms, including uses of your Practice Program Information by Program Providers.

Aggregated Data Analysis

EXLI may also automatically collect and analyze Information about your general usage of the Platform, Services and Practice Programs. We might track your usage patterns to see what features of the Platform, Services and Practice Programs you commonly use, Platform traffic volume, frequency of visits, type and time of transactions, type of browser, browser language, IP address and operating system, and statistical information about how you use the Services and Practice Programs. We only collect, track and analyze such Information in an aggregate manner that does not personally identify you. This aggregate data may be used to assist us in operating the Platform and the Services and provided to other third parties to enable them to better understand the operation of the Services, and improve their Practice Program offerings, but such information will be in aggregate form only and it will not contain personally identifiable data.

How We Protect Your Information

Any information you provide will be held securely and in accordance with applicable privacy laws. We do not provide your personal information to any third party without your specific consent. We take your privacy seriously and work hard to protect our Users from unauthorized, third-party access to your Information. We encrypt many of our Services using the Secure Socket Layer (SSL) technology and restrict access to personal information to select EXLI customer service personnel who will only access Your information in order to support you in performing specific tasks and functions at your request.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Services, we ask that you do not share your password with anyone. Account passwords are encrypted, which means we can’t see your passwords. We can’t resend forgotten passwords either. We’ll only reset them.

The security of your personal information is important to us. EXLI employs procedural and technological measures to protect your personally identifiable information. These measures are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration or destruction. We may use software, secure socket layer technology (SSL) encryption, password protection, firewalls, internal restrictions and other security measures to help prevent unauthorized access to your personally identifiable information. However, EXLI cannot guarantee that unauthorized third parties will never be able to defeat these measures or use your personally identifiable information for improper purposes. Therefore, you should be aware that when you voluntarily display or distribute personally identifiable information, that information could be collected and used by others. EXLI is not responsible for the unauthorized use by third parties of information you post or otherwise make available publicly.

Disclosure of Your Information

We never sell your personal information. We may share your personally identifiable Platform Information with third parties only in the ways that are described in this Privacy Policy. These include, but are not limited to:

  1. Third parties that perform services on our behalf so we can provide and improve our services. For example, we may disclose Personal Information for customer support by third parties. These third parties must abide by this Privacy Policy and keep nonpublic information confidential and use it only for its intended purpose.

  2. Program Providers (in which case this will become Practice Program Information);

  3. Coaches and Mentors whose services you specifically opt-in for;

We may also disclose your personally identifiable information:

  1. If we are required to do so by law, regulation or other government authority or otherwise in cooperation with an investigation of a governmental authority;

  2. To enforce the Terms of Use, or;

  3. To protect the safety of Users of our Platform and our Services and Practice Programs;

  4. In addition, we may transfer your personally identifiable information to a successor entity upon a merger, consolidation or other corporate reorganization.

We retain Platform Information and the personal data we process on behalf of Users for as long as needed to provide the Services. We will retain and use this personal Platform Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements with Users, and/or the period required by laws in applicable jurisdictions. Please see the sections above for how Practice Program Information may be used.

Links to Third Party Services and Websites

The Platform, Services and in particular the Practice Programs, may provide links to third party web sites or resources not associated with EXLI and over which EXLI does not have control (“External Web Platforms”). Such links do not constitute an endorsement by EXLI of the External Web Platforms, the content displayed therein, or the persons or entities associated therewith. You acknowledge that EXLI is only providing these links as a convenience, and cannot be responsible for the content of such External Web Platforms.

Children and Minors

The Platform and Services are designed for persons 18 years of age and older. Children between the ages of 13 and 18 (or the age of majority in their jurisdiction of residence) (“Minors”) may use the Services, but use by such Minors shall only be done with the guidance, supervision, and consent of their parents or guardians. We rely on parents and guardians to ensure Minors only use the Services if they can understand their rights and responsibilities as stated in the Terms & Conditions applicable to the Services (the “Terms”). If you are a parent or guardian and you provide your consent to your child’s use of the Services, you agree to be bound by this Privacy Policy and the Terms. Children under the age of 13 are not permitted to use the Services. If you are under the age of 13, please do not attempt to access or use the Services. If you believe that we may have collected any personal information from a child under 13, please notify us at support@pollinate.life so we can delete this information.

Updating, Correcting and Deleting Your Information

If you believe that EXLI has incorrect Account Information or Practice Program Information that was provided as part of the Services, you may correct, amend, or delete that information. We can only alter Practice Program Information that was initially provided to us via the Platform; you need to contact the Program Provider for other purposes.

From time to time, we may send you emails about Practice Programs or new or modified Services that we believe might interest you. If you wish to opt-out of receiving these materials, you may follow the unsubscribe procedures provided on the Site or in email.

Privacy Policy Changes

EXLI reserves the right to change this Privacy Policy from time to time. We will post the revised Privacy Policy on this Platform located at www.pollinate.life/privacypolicy and will either send a notice to the e-mail address that you specified in your registration and/or post notice of the change so it is visible when users log-on for the first time prior to said changes taking effect so that you are always aware of what personal information we may collect and how we may use this information. We encourage you to review this Privacy Policy regularly for any changes. Your continued use of the Platform and/or Services will be subject to the then-current Privacy Policy.
